European Court Bans GMO Potato After Hungary Challenge
The European Court on Friday ruled against the European Commission’s approval of the cultivation and sales of GM potato seeds. The commission’s decision in 2010 to allow sales of BASF’s Amflora potato had been challenged by Hungary at the Luxembourg-based court, and supported by France, Luxembourg, Austria and Poland.

The court said the commission had failed to follow the rules of authorisation. Had it complied with the rules, the result of the procedure or the content of the contested decision could have been substantially different, it said. Hungary brought the action, fearing the consequences to health and the environment.
