European Court Says Hungarian Rules On Notaries In Line With EU Law
The European Court of Justice ruled that Hungarian law allowing a notary to affix an enforcement clause to a contract without scrutinising whether the underlying contract contains unfair conditions does not go against European Union law.

The case the court ruled on involved a Hungarian borrower who defaulted on his mortgage but argued before a local court that the enforcement clause affixed to his loan contract afterward should be cancelled because the terms of the underlying FX loan contract were unfair.

The relevant EU directives “do not preclude national legislation…” the court said.
